Die Übertragung von Aufgaben auf die Ausschüsse des Bundestages ist eine verfassungspolitische Realität, deren Bedeutung für die praktische Arbeit des Bundestages nicht unterschätzt werden kann. Ein wesentlicher Teil der Arbeit des Bundestages finden in den Ausschüssen statt, indem diesen die Vorbereitung von Plenarbeschlüssen und die Ausübung von Kontroll-, Informations- und Untersuchungsrechten übertragen werden. Dem steht die verfassungsrechtliche Tatsache gegenüber, dass das Ausschusswesen in weiten Teilen nicht ausdrücklich geregelt, sondern stark durch parlamentarische Traditionen und die Rechtsprechung des Bundesverfassungsgerichts geprägt ist. Besondere Relevanz gewinnt die Frage nach den Grenzen solcher Übertragungen, wenn Aufgaben, die traditionell durch das Plenum wahrgenommen wurden, nicht nur zur Vorbereitung, sondern sogar zur plenarersetzenden Wahrnehmung auf Ausschüsse übertragen werden sollen.

Woraus ergibt sich die Legitimation Deutschlands zur Bestrafung eines kolumbianischen Drogenhändlers, der Kokain aus seinem Land in die USA schmuggelt? Diese Frage wird in der Regel nur aus der Sicht des Völkerrechts erörtert. Allerdings interessiert sich das Völkerrecht, das sich vor allem mit dem Ausgleich zwischen staatlicher Souveränität und effektiver Bekämpfung grenzüberschreitender Kriminalität befasst, kaum für die Rechtfertigung von Strafnorm und Strafe gegenüber dem von ihr Hauptbetroffenen. Hierauf mag die Betonung des relationalen Charakters der strafrechtlichen Verantwortlichkeit eine sachgerechte Antwort liefern, oder präziser ausgedrückt, der Gedanke, es gebe keine legitime Ausübung des ius puniendi ohne das Vorliegen einer (im materiellen Sinne verstandenen) politischen Bindung (Staatsbürgerschaft) zwischen Strafgewaltstaat und Normadressat. Nach einer Untersuchung der Vorzüge und Schwächen verschiedener Modelle eines sog. "Bürgerstrafrechts" wird ein eigener "bürgerstrafrechtlicher" Ansatz vorgelegt, der neben einer deutlichen Abgrenzung des Strafanwendungsrechts auch weitreichende Auswirkungen auf die Bestrafung sozial Ausgegrenzter entfalten kann.
