The book analyzes socioeconomic through the lens of a lawyer. In the past decade the world has witnessed some severe financial and economic crises, espe­cially the financial crisis of 2007-2008 and the crisis caused by the COVID-19 pandemic. The author states that the socio-economic order has in the past four to five decades been thoroughly redesigned, generally favouring models that prio­ritize the free market over the public interest or even, more generally, government operation. He works out that during four to five decades, globalized, capitalist societies are facing a multiplicity of fundamental problems, such as: (1) increasing debt that severely burdens both the private and public sectors; (2) persistent poverty and an ever-increasing polarization between rich and poor, in addition to (3) intractable environmental problems that, fifty years after the Club of Rome's report entitled 'Limits to growth' (1972), has dragged the world into what in recent years has been referred to as "climate change."The book explains why all this is the direct result of value choices made from the late Middle Ages onwards, when in the Western world the societal models of that time were increasingly abandoned for a societal model that came to rely on the primacy of economic interests. The book not only subjects the ethical choices but also examines various problems it has caused and probes for possible ways out.This is an open access book.

Die Monographie beschäftigt sich mit dem Rechtsrahmen für Wettbewerbsbeschränkungen auf internationalen Level. Hierzu werden zunächst die Möglichkeiten der extraterritorialen Anwendung von nationalen Wettbewerbsgesetzen und deren Wirksamkeit analysiert. Aufgrund der mangelnden Effektivität werden multilaterale Initiativen der WTO, OECD und UNCTAD berücksichtigt, die jedoch aufgrund der fehlenden Bindungswirkung als Lösung ausscheiden. Im Anschluss werden das europäische Wettbewerbssystem und die Abkommen der EU mit Drittstaaten untersucht, hierbei wird unterschieden nach dem Integrations- bzw. Assoziierungsgrad der einzelnen Staaten. Teil der Analyse sind insbesondere die spezifischen Wettbewerbsabkommen der EU bzw. der MoU der Wettbewerbsbehörden, aber auch der Assoziierungs- und Freihandelsabkommen. Abschließend wird anhand der Ergebnisse ein eigener Vorschlag für einen internationalen Rechtsrahmen vorgelegt.

This book provides a deeper understanding of electronic evidence and its use in civil and commercial dispute resolution. The explosive growth of information technology has had major impacts on the development of the economy, society and also on the improvement of legal proceedings with the use of modern technology in all areas of criminal and civil procedures.This book focuses on the current provisions of UNCITRAL, the European Union, Germany and Vietnam concerning electronic evidence in civil and commercial dispute resolution. It analyses the notion and the basic aspects of evidence and electronic evidence and explores the process of finding electronic evidence. Further, it discusses how the effectiveness of finding electronic evidence can be reconciled with a respect for fundamental rights, in particular with personal privacy and personal data protection. The book subsequently addresses the authentication and admissibility of electronic evidence; the evaluation of electronic evidence and the burden of proof; and the challenges of using electronic evidence in civil and commercial dispute resolution. Finally, it puts forward proposals for promoting the use of electronic evidence in these contexts. As the book focuses on the current texts of UNCITRAL and the civil procedure legislation of the European Union, Germany and Vietnam, it relies on a comparative method which deals with the most significant provisions of the above legislation.

This report examines the opportunities for developing equitable and efficient means to manage water resources in the Dudh Koshi river system in Nepal. The report suggests economically and environmentally sustainable management considering challenges that involve climate change. The study proposes a strategic planning framework that covers the holistic, technical, economic, social, and environmental aspects of integrated water resources management and development of the river system. It also contributes to strategic planning from a basin-wide perspective by supporting the design of the Dudh Koshi Storage Hydroelectric Project.

Die Autorinnen und Autoren dieses Tagungsbandes geben vielseitige Einblicke in das interdisziplinäre Themenfeld Mergers & Acquisitions, so dass mit 20 Beiträgen ein breit angelegter Überblick über den aktuellen Diskurs in Wissenschaft und Praxis vorliegt. Die Schwerpunkte der Tagung und des Buches konzentrieren sich auf einen rechtswissenschaftlichen und einen wirtschaftswissenschaftlichen Teil. Die Fachtagung "Mergers & Acquisitions im Spannungsfeld der Rechts- und Wirtschaftswissenschaften - Aktuelle Erkenntnisse aus Forschung und Praxis" fand im November 2013 statt.

The primary contribution of this book is to integrate the important disciplines which simultaneously impact the investment appraisal process. The book presents a study that develops a new approach to investment appraisal which uses a multiple objective linear programming (MOLP) model to integrate the selected disciplines which include capital markets, corporate governance and capital budgeting. The research covers two case studies, one in the e-commerce sector and another in the airline industry in which the above disciplines are integrated. Readers from the areas of corporate governance, regulation, and accounting would find the survey of different approaches and the new integrated optimization approach particularly useful.  ¿

Im Zuge der Finanzkrise ist die Europäische Wirtschafts- und Währungsunion (WWU) tiefgreifend umgestaltet worden. Die WWU war zuvor stark hinkend: Eine vollendete Währungsunion war auf eine nur schwach koordinierte Wirtschaftspolitik gestützt. Die Finanzkrise hat den Willen gestärkt, entschiedene Schritte in Richtung einer echten Wirtschaftsregierung ("economic governance") zu setzen. Die "neue WWU" weist noch zahlreiche Bruchstellen auf. An anderen Stellen wird weiter gebaut. Insgesamt zeigt die WWU mittlerweile aber einen weit stärkeren Integrationsgrad. Den EU-Mitgliedstaaten wird einerseits eine größere Haushaltsdisziplin abverlangt, andererseits aber auch mehr wechselseitige Solidarität. In diesem Sammelwerk nehmen namhafte Experten eine Bestandsaufnahme zur WWU vor und verweisen auf die sich abzeichnenden Entwicklungslinien der neuen europäischen Finanzarchitektur. Ausführlich analysiert wird die einschlägige Rechtsprechung von EuGH und BVerfG. Behandelt werden Six-Pack, Fiskalpakt und ESM. Die Analyse erfolgt sowohl aus europarechtlicher, völkerrechtlicher und verfassungsrechtlicher Perspektive als auch aus wirtschaftswissenschaftlicher und politikwissenschaftlicher Warte.

The volume contains articles based on presentations given at a conference hosted by the Institute for Law and Finance of Goethe University on October 27, 2011. Collective action clauses are an example of the typical dichotomy of financial regulation: While the problems are economic in nature, the solutions need to be implemented by law. The Institute for Law and Finance strives to bring together law and finance in order to foster a better mutual understanding of both disciplines and to improve the regulation of financial markets. Thus, the organizers are particularly pleased that eminent experts from the fields of law and finance agreed to participate in the event and to share their views on and experiences with collective action clauses. The presentations given at the conference have been updated in 2012 to reflect recent developments.
