'Article 15 GDPR as an Information Lever in D&O Litigation': The author analyses how Art. 15 GDPR may impact the position of former directors and officers in D&O litigation. They regularly find themselves in a pronounced need for evidence. Against the background of the data protection jurisprudence of the European Court of Justice, the author shows that Art. 15 GDPR serves as an information lever in certain constellations by enabling a ¿due diligence of personal datä in D&O litigation.

Sometimes core international crimes are only investigated and prosecuted decades after the relevant conduct took place. This has been the case in Bangladesh, Cambodia and Timor-Leste, to mention three examples discussed in this book. It addresses challenges associated with such delayed criminal justice and the evidence it must necessarily rely upon. It draws on contributions by some of the most experienced prosecutors and judges in international criminal justice as well as leading academic experts, on questions related to 'old evidence'. This revised and expanded second edition (2024) brings together contributions by Shafique Ahmed, Andrew T. Cayley, David Cohen, Seena Fazel, Siri S. Frigaard, M. Amir-Ul Islam, Md. Shahinur Islam, Moa Lidén, Agnieszka Klonowiecka-Milart, Mahdev Mohan, Alphons M.M. Orie, Stephen J. Rapp, Sriyana, Anya Topiwala, Patrick J. Treanor and Martin Witteveen, in addition to the editors Morten Bergsmo, Cheah Wui Ling and Antonio Angotti. The chapters discuss challenges encountered in practice and suggest solutions that can be tailored to fit the circumstances of the case or country. By providing a comprehensive analysis of the main problems in this area and a variety of views, the anthology serves as an invaluable resource for criminal justice actors and researchers seeking to address questions of 'old evidence'.

It was a day like any other. James got up, made coffee, then retrieved the mail. Placing the day's stack of bills, sales catalogs, and the like on the counter, James sat on the barstool, one arm bracing himself at the counter. He sipped his coffee, blowing it just a bit to cool it down. In front of him, an envelope taunted him, seemingly pulsing. Inside, its contents awaiting to change his world, if it didn't end it first. James did not know it yet, but in that early afternoon hour, he was now part of the 2%.***The Murders in the Rue Morgue to A Tangled Web: A Cyberstalker, a Deadly Obsession, and the Twisting Path to Justice. Should they get their mail? Should they answer the knock at their door? What entity is on the other end of that knock? A tale in which the book holder's own life could intertwine and be forever changed. Are you brave enough to stand up to the unknown?***Excerpt:Within the black and white photos of the shoe box, I see my dad. Tall, skinny, always with a big grin.He had a kind heart, liked to have a few beers, and enjoyed his Marlboro reds, just like I had years ago.You could say I was taking on the family tradition of drinking and smoking, at least until I had problems breathing. Drinking continued for a few more years after the cigarettes became history.I thought of my dad a lot more these days. More than I had before my life went to hell.Every night, just before my eyes closed in sleep, I would hope to be with him, where-ever he was.***

Today, lawyers and clients devote a great deal of time, effort, and expense to discovery. More often than not, discovery, and not trial, is the central battleground of a case. Most civil lawsuits in federal court end before trial, either by pretrial settlement or on dispositive motion. In either case, the fruits of discovery can be critical to the outcome. The need for analytical and strategic guidance on problems in discovery is heightened by the fact that much of it is handled by relatively inexperienced lawyers, and in the case of document production, legal assistants. Effective discovery is crucial. This book is written to address that need. It describes the problems that civil litigators encounter most frequently in pretrial discovery and presents suggestions and strategies for solving these problems. Following a background discussion on the scope and types of discovery, discovery problems are presented as hypotheticals (many of which the authors have encountered in their experience) followed by a discussion that includes the law and helpful practice tips. In this edition, particular emphasis has been placed on discussion and interpretation of the new rules, and evolving case law, concerning discovery of electronically stored information (ESI).

Judges were never bound by law to convict a defendant unless they considered him guilty. Yet, they could be prohibited by law from convicting a person they consider guilty due to the absence of legally prescribed or the presence of legally prohibited evidence. Evaluation of Evidence addresses the question: should the law restrict the freedom of judges in assessing the probative value of evidence in the criminal process? Tracing the treatment of evidence from pre-modern to modern times, Mirjan Dama¿ka argues that there has always been some understanding about rules regarding the use and treatment of evidence, and these rules should not be looked askance as a departure from ideal arrangements. In a time when science and technology have the ability to contribute to factual inquiry, there needs to be acceptance of rules that expand or corroborate evidence produced by our native sensory apparatus.

This book discusses how fact-finding mechanisms for alleged violations of international human rights, humanitarian and criminal law can be improved. There has been a significant increase in the use of international(ised) and domestic fact-finding mechanisms since 1992, including by the United Nations human rights system, international commissions of inquiry, truth and reconciliation commissions, and NGO fact-finding. They are analysed and assessed in detail by 22 authors under the common theme ‘Quality Control in Fact-Finding’. The authors include Richard J. Goldstone, Martin Scheinin, LIU Daqun, Charles Garraway, David Re, Simon De Smet, FAN Yuwen, Isabelle Lassée, WU Xiaodan, Dan Saxon, Christopher B. Mahony, Dov Jacobs, Catherine Harwood, Lyal S. Sunga, Wolfgang Kaleck, Carolijn Terwindt, Ilia Utmelidze and Marina Aksenova. This Second Edition includes new chapters by Geoffrey Robertson QC, Emma Irving and William H. Wiley, as well as a new foreword by Mads Andenæs.The book considers how the quality of every functional aspect of fact-finding can be improved, including work processes to identify, locate, obtain, verify, analyse, corroborate, summarise, synthesise, structure, organise, present and disseminate facts. Emphasis is placed on the nourishment of an individual mindset and institutional culture of quality control. This book concerns fact-work outside criminal justice systems. It is supplemented by Quality Control in Preliminary Examination: Volumes 1 and 2 and Quality Control in Criminal Investigation in the same Series.
