Condamnation

'The Direct and Analogous Scope of Application of § 16 II StGB': This thesis examines the criteria for both the direct and analogous scope of application of § 16 II of the German Criminal Code (StGB). It demonstrates that despite its limited practical relevance in terms of direct applicability, the normative weight of § 16 II StGB stands doctrinally on equal footing with the more practically significant § 16 I StGB.

*Winner of the Nautilus Book Award (Silver) for Journalism and Investigative Reporting*<BR> <BR>A riveting account of one inmate’s quest to die on death row—and a fearless look at a system of punishment that has failed the public it claims to serve. <BR><BR>When Scott Dozier was sent to Nevada’s death row in 2007, convicted of a pair of grisly murders, he didn’t cry foul or embark upon a protracted innocence campaign. He sought instead to expedite his execution—to hasten his inevitable death. He decided he would rather face his end swiftly than die slowly in solitary confinement. In volunteering for execution, Dozier may have been unusual. But in the tortuous events that led his death date to be scheduled and rescheduled, planned and then stayed, his time on death row was anything but.<BR> <BR> In The Volunteer, Emmy Award–winning investigative reporter Gianna Toboni traces the twists and turns of Dozier’s story, along the way offering a hard look at the history and controversy that surround the death penalty today. Toboni reveals it to be a system rife with black market dealings and supply chain labyrinths, with disputed drugs and botched executions. Today’s death penalty, generally carried out through lethal injection, has proven so cumbersome, ineffective, and potentially harrowing that some states have considered a return to the electric chairs and firing squads of the past, believing those approaches to be not only more effective but more humane.<BR> <BR> No matter where you stand on the morality of capital punishment, there’s no denying that the death penalty is failing the American public. With costs running into the billions and countless lives kept in limbo, it has proven incapable of achieving its desired end: executing the inmates that fellow Americans have deemed guilty of the most heinous crimes. With The Volunteer, Toboni offers an insightful and profound look at how the death penalty went so terribly wrong. A spellbinding story down to its shocking conclusion, it brings to light the horrifying realities of state-sanctioned killings—realities that many would prefer to ignore.

'Murder Law and Nazi Legal Legacy: An Examination of the Murder Criteria in German Case Law (§ 211 German Criminal Code)': This study examines the case law on the murder provision (§ 211 StGB/German Criminal Code), introduced in 1941 and mainly unchanged to this day. It presents the origin and development of § 211 StGB and analyzes all Federal German rulings. The study shows that judicial decisions after 1945 and partly to this day remain influenced by Nazi ideology-characterized by linking law and morality and vague interpretations aimed at upholding material justice-through the application of the murder criteria.

'The Right of Clemency. A Contemporary Complement to German Sanctions Law?"': The thesis demonstrates, through analysis of clemency regulations and empirical data, that clemency as a case-by-case corrective measure still retains its legitimacy within the current legal system. Furthermore, gaps and discrepancies in clemency law are identified, and concrete reform proposals are put forward aimed at establishing a fair, legally compliant, transparent, and uniform clemency framework.

'Toward Rational and Consistent Sentencing. Empirical, Comparative, and Reform-Oriented Studies': Sentencing is a central issue of current debates on criminal justice reform. This volume presents the results of empirical studies on sentencing, including evaluations of the reasons given by judges for sentences imposed in cases of rape and residential burglary, an analysis of appellate court decisions on matters of sentencing, and findings from an empirical study on lay persons' and judges' notions of just sentencing. Chapters on sentencing in England and Wales and on reform options complement the empirical enquiries.

A new breed of reform-minded prosecutors tells their stories about the challenges and successes of making change from inside the system Growing up in Chicago’s Cabrini-Green housing projects, Kim Foxx never anticipated that she would become the chief prosecutor in the country’s second-biggest county. When Chesa Boudin was a baby, his parents were arrested and incarcerated. Visiting them in prison for decades helped shape his convictions about what justice does—and doesn’t—look like in the United States. Now, along with eleven other reform-minded prosecutors voters put in office throughout the country, they reflect on the task they set for themselves: making change from within. Using the power of their office, which has traditionally fueled mass incarceration and harsh punishments, this new breed of elected prosecutors has joined the movement to shake up the justice system. In Change from Within, these visionaries describe their journeys to office, what they are doing to change “business as usual,” the pushback they’ve experienced, and their thoughts on reforms that are possible working from the inside. Published in partnership with Fair and Just Prosecution (FJP), drawing from interviews conducted by FJP executive director Miriam Krinsky, a former federal prosecutor, this unprecedented book includes intensely personal first-person profiles of thirteen transformative DAs. Each story is accompanied by an image inspired by the prosecutor and created by a formerly incarcerated artist.
